Things are looking up for the truck manufacturers – and Mercedes-Benz in particular since the criminal cartel investigation carried out by the OFT under the Enterprise Act has been closed. The investigation was into suspected cartel activity in the UK involving commercial vehicle manufacturers in September 2010. According to the OFT they have, “determined that there is insufficient evidence for any individual to be charged with the cartel offence. Accordingly, that case has been closed.” When the investigation was launched in September 2010, the OFT raided the UK offices of Mercedes-Benz and MD Ian Jones was temporarily detained. All charges against Jones have also been dropped.
MAN, Volvo and Scania all received requests for information from the OFT at the time. The OFT said on its website that the civil investigation was still ongoing and was at an early stage. “The OFT will not be in a position to conclude whether it considers the law has been infringed until it has completed its investigation and assessed the available evidence,” it said.
